A New I-9 Form was announced for 2022 but never got here as of yet. We expect that the new I-9 form will be created and launched by 2023. However, we do know what the proposed changes are and what Employers and Employer representatives need to prepare for. DHS has issued a requirement that Employers may use the expired October 31, 2022, I-9 form effective November 1, 2022, until the new I-9 form is launched. Compliance best practice is to indicate any changes in DHS requirements like using expired documents, and the Employer should create a document confirming the change and the effective date as a compliance effort.
DHS has extended the date of the remote I-9 Form option to July 31, 2023, which is helpful but only for fully remote employees. Although the extension is to the end of July 2023, Employers still must follow all the requirements until normal operations resume according to DHS.
DHS revised some of the ID documents to reduce the risk of fraud and counterfeiting.
At the end of January 2023, DHS revised some of their ID documents to become effective based on the expiration date of the identified documents. These revisions will need to be used to reduce the risk of fraud and counterfeiting, USCIS redesigns the Permanent Resident Card (PRC) every three to five years.
The I-9 form preparation, correction, and internal audit are still a headache and even a nightmare for Employers and professionals.
